Copyright Acknowledgement and Liability Waiver and Release. (i) Kerry B Smith Photography has the right to use all photographs or images in any form, including without limitation the right to prepare derivative works, for business, advertising, re-printing, publishing, displaying, and copyright purposes; (ii) All photographs or images are copyright protected to Kerry B Smith Photography and shall not be copied, scanned, saved on hard drive, printed or otherwise reproduced or duplicated without express written permission from Kerry B Smith Photography (iii) Neither Kerry B Smith nor Kerry B Smith Photography shall be responsible or liable for the safety of any client, other person or property during photography sessions. As such, on behalf of myself and each other person participating in the photography session on the date set forth below (the “Releasors”), I hereby covenent not to sue, release, waive and discharge Kerry B Smith, Kerry B Smith Photography and any of their respective agents or employees (the “Releasees”) from any and all liability, claims, demands, actions and causes of actions whatsoever arising out of or relating to any loss, damage or injury, including death, that may be sustained by any Releasor, whether caused by the negligence of the Releasees, or otherwise, while participating in any photography session, or while in, on or upon the premises or location where the photography session is being conducted, while in transit to or from, or in any place or places connected with the photography session; (iv) I am over the age of eighteen (18) and have the authority to grant the rights described in this Copyright Acknowledgement and Liability Waiver and Release. I have read the foregoing release, waiver and acknowledgement and understand it, and sign it voluntarily as my own free act and deed./strong
